TissuTrak (“TissuTrak”) values your trust, and protecting your information is a high priority. TissuTrak is committed to your privacy. This Privacy Policy explains what information TissuTrak and its affiliates (collectively, “TissuTrak” or “We”) collect, how information is collected, how we use that information, what information is shared with whom, and how TissuTrak protects your information when you use our products and services (“Services”).

1. When This Privacy Policy Applies

Our Privacy Policy applies to all the Services offered by TissuTrak, and its affiliates, including Services offered on other sites, but excludes Services that have separate privacy policies that do not incorporate this Privacy Policy, and Services that you may receive as a result of your participation in a program that expressly supersedes this Privacy Policy.

Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include services, or other sites linked from our Services. Our Privacy Policy does not cover the information practices of other companies and organizations who advertise our Services, and who may use cookies, pixel tags and other technologies to serve and offer relevant ads.

The information TissuTrak collects varies based on the type of Services you use and the manner in which you access them. We do not sell any identifiable or sensitive information (“Personal Information”) about you at this time. Depending on these factors, TissuTrak may collect the following information about you:

  • Personal Information. Including name, email address, date of birth, phone number, and gender.
  • Personal Health Information. Including medical diagnosis, previous medical conditions or procedures, allergies, medical history, current health symptoms, and medications.
  • Device Information and other Unique Identifiers. Including device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, or similar unique identifiers.

3. How We Collect Information

We collect information in the following ways:

  • Information You Provide. When you email us, use our Website, or interact with our Services, you will provide us with some of the information referenced above.
  • Cookies and Anonymous Identifiers. We use various technologies to collect and store information when you visit a TissuTrak service, and this may include sending one or more cookies or anonymous identifiers to your device, pursuant to our Cookie Policy. We also use cookies and anonymous identifiers when you interact with Services we offer to our partners, such as TissuTrak features that may appear on other sites.
  • Tracking Pixels. Our Website may employ software technology called tracking pixels (a/k/a web beacons/web bugs/clear gifs) that enable us to better manage the content on the Website by informing us what content is effective. Tracking pixels are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of visitors to a website. In contrast to cookies, which are stored on a user's computer hard drive, tracking pixels are imbedded invisibly on website pages and are about the size of the period at the end of a sentence. We do not tie the information gathered by tracking pixels to your personally identifiable information.

We use analytics tools and other third-party technologies, such as Google Analytics, to collect non-personal information in the form of various usage and user metrics when you use our site.   • To Improve Our Services. We use de-identified, anonymous information that we collect about you for statistical and analysis purposes to improve our products and services, and to provide statistical analysis.

No data is sold to third parties, however aggregate data may be disclosed to third parties to fulfill a legitimate business purpose.

When requesting access to your Personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the Personal information that we hold about you. Your right to access or delete the Personal information we hold about you is not absolute.

There are instances where applicable law or regulatory requirements allow or require us to refrain from taking certain actions with respect to some or all of the Personal information that we hold about you. In addition, some or all of the Personal information may have been destroyed, erased or made anonymous. In the event we cannot provide you with access to your Personal information, or we are unable to delete it, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

Right to correct your information.

This includes consents regarding your participation in certain Services, email/text/other communication consents, or any other consent that you have provided to TissuTrak. Right to object or opt-out at any time.

You have the right to object at any time to receiving marketing or promotional materials from us by either following the opt-out instructions in commercial e-mails or by contacting us, as well as the right to object to any processing of your Personal information or to participating in any program. We will consider any request you make to us, and provide a reply in a timely manner, according to our legal, ethical and contractual obligations. Nevada Residents.

Nevada provides its residents with a limited right to opt out of certain Personal Information sales. Residents who wish to exercise their sale opt-out rights may submit a request as provided in the Contact Us section below. However, please know we do not sell data triggering that statute's opt-out requirements.

Exercising Your Data Subject Rights

How We Verify Data Subject Rights Requests

We may require that your identity be verified prior to processing verifiable rights requests. If your request requires verification, we will verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity, we may request additional information from you, consistent with applicable law. We may deny a rights request if we are unable to verify your identity.

Authorized Agents

Some U.S. states permit their residents to designate an authorized agent to submit requests to exercise certain data subject rights on the individual's behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law, we may still require that you verify your identity depending on the nature of the request and sensitivity of the information at issue.

You must include a copy of the written, signed permission indicating that you are permitted to act on that person's behalf.

Appealing a Denied Data Subject Rights Request

In some circumstances, we may deny your request to exercise one or more of the rights described above. Some U.S. states permit their residents to appeal a denied data subject rights request. Depending on in which U.S. state you reside, if you disagree with our decision to deny your request or any portion of your request, you may appeal our decision within sixty (60) days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than sixty (60) days after you have been notified of our decision to deny the request, we may deny your appeal. If you submit a timely appeal, we will respond within forty-five (45) days of our receipt of your appeal.

As required by law, we will recognize universal opt-out mechanisms or opt-out signals sent through your browser to opt-out of the selling or sharing, as defined by applicable law, of your Personal Information.

California Residents.

If you are a resident of California, you are granted specific rights regarding access to your Personal Information. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about certain categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident please note that it is our policy not to share Personal Information of California Residents with third parties for their direct marketing purposes if those individuals have exercised their right to opt-out. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA Privacy Notice

Will your information be shared with anyone else? We may disclose your Personal Information as described above. We disclose Personal Information with our vendors pursuant to a written contract between us and each vendor. Each vendor is a for-profit entity that processes the information on our behalf.

We may use your Personal Information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your Personal Information.

8. Retention of Collected Information

Except as otherwise permitted or required by applicable law or regulatory requirements, we will retain all data collected through your use of our Services only for as long as we believe it is necessary to fulfill the purposes for which the data was collected (including for the purpose of meeting any legal, accounting or other reporting requirements or obligations).
